In the current political climate, the Fourth Estate must act as more than a witness; we must serve as a digital powerhouse for transparency and a guardian of constitutional fidelity. As federal civil rights protections are systematically rolled back, the battle for institutional accountability has shifted decisively to the state level.
In Ohio, our only definitive call to action remains the power of the citizen-led ballot initiative.
The Gubernatorial Litmus Test
The 2026 race for the governor’s mansion is a critical juncture for our state. We must demand that any candidate seeking to lead Ohio publicly declares their stance on the five active citizen-led ballot measures. A true constitutionalist does not fear the people’s right to direct legislation; they embrace it as the ultimate check on government overreach. We are calling on all candidates to endorse these measures as a demonstration of their commitment to the "consent of the governed."
The Five Essential Pillars of Accountability
To restore the balance of power, we must support the following five measures:
Protecting Ohioans’ Constitutional Rights: This amendment provides the legal framework to sue government actors for constitutional violations by ending the doctrine of Qualified Immunity and Sovereign Immunity. By embedding government accountability directly into our founding document, we ensure all government officials are held accountable for the deprivation of any Ohioan's constitutional rights.
Ohio Equal Rights Under the Law: A state-level guarantee of equality designed to safeguard all citizens against the erosion of federal civil rights protections.
Citizen-Led Redistricting: An initiative to remove partisan bias from the map-making process, ensuring that voters choose their politicians.
Property Tax Elimination: A measure to prohibit the state from taxing real property, securing the fundamental right to true property ownership.
No Data Centers Initiative: A strategic measure to halt the unregulated expansion of high-consumption data centers that threaten our local energy grid, land use, and environmental resources without sufficient public oversight.
National Legislative Momentum: Ohio’s Own Warren Davidson
The movement to dismantle the shield of immunity is gaining ground, and Ohio is at the forefront of this federal push. We recognize the leadership of our own Representative Warren Davidson (R-OH). Representative Davidson has been a consistent champion for the Fourth Amendment, working to reintroduce the principles of the Ending Qualified Immunity Act originally authored by Thomas Massie (R-KY).
Furthermore, we highlight the historic contribution of Congressman Dan Goldman (D-NY). As a member of the Jewish community and heir to the Levi Strauss & Co. fortune, Representative Goldman has utilized his platform to challenge unchecked federal power. In early 2026, he introduced the ICE OUT (Oversight of Unchecked Tactics) Act, legislation specifically designed to strip qualified immunity from federal agents and codify the right of citizens to sue for constitutional violations.
These efforts represent a necessary pincer movement between state and federal action to restore the Fourth and Fourteenth Amendments.
Ohio as Case Precedent for the Nation
With federal civil rights protections under threat, the "Protecting Ohioans" initiative serves as a vital blueprint for the 31 states that currently allow for citizen-led constitutional amendments. States such as California, Florida, Michigan, Arizona, Nevada, and Illinois have the authority to adopt this language as a defensive precedent. By embedding the "Right to Sue" within state constitutions, these 31 states can ensure that justice remains accessible even when federal standards fail. This is especially urgent as modern policies increasingly mirror Jim Crow-era restrictions, specifically impacting political Black leaders and grassroots organizers.
We are witnessing an attempt to reframe fundamental rights as mere privileges. Our movement is the direct response—a century-long journey of resilience translated into legislative action. The ballot is our most potent weapon. It is time for us to lead the way in reclaiming the Constitution.
